What changed: added a copyright (DMCA) notice process, a formal arbitration and class action waiver in place of courts-only litigation, a 5 business day removal window for dealer listing corrections, and clearer rules on accounts, third-party services and how these terms can change. The shop, dealer and marketplace rules you already agreed to are carried forward with more detail.
MotoGossip (motogossip.com) is owned and operated by Gossip Apps LLC, a Texas limited liability company (“MotoGossip”, “we”, “us”). These Terms of Use are a binding agreement between you and MotoGossip. The Privacy Policy and any product-specific policy we post (for example shop or dealer terms) are part of these Terms. By browsing the site you accept the parts that apply to visitors. By creating an account, signing in, checking the box, posting a listing, buying a featured listing, managing a dealer page, or ordering from the shop, you accept all of them. If you do not agree, do not use the site.
MotoGossip collects publicly advertised motorcycle listings, hosts listings posted by riders and dealers directly, shows each asking price against comparable bikes, links to motorcycle news, lists parts, and sells MotoGossip merchandise. Listings belong to the sellers and dealers who post them. Prices, availability, condition and descriptions are theirs, and can change or disappear at any time.
“Under”, “fair” or “over” describes where an asking price sits among comparable listings on our index (same make, model and year, similar mileage, nearby). It is not an appraisal, a valuation, a guarantee, or a recommendation to buy or not buy. The condition, history and paperwork of a specific bike are between you and the seller.
MotoGossip is a listing venue. We are not a party to any sale, we do not inspect vehicles, and we do not verify titles, odometer readings, VINs or the identity of sellers or dealers. Buyers must inspect a bike and its paperwork before paying. Sellers are responsible for the accuracy of every fact in their listing and for following the law that applies to selling a vehicle, including honest odometer disclosure under 49 U.S.C. 32705, title transfer rules, lemon and consumer protection law, and dealer licensing where the seller is a business. There is no escrow on MotoGossip and we never hold funds for a sale: never wire money to a stranger, and meet in a safe public place.
MotoGossip shows advertising, including third-party ads served by Google AdSense and paid promotions such as featured listings. Advertisers are responsible for their own ads. Sponsored or featured content is marked as such. Ads are not endorsements. Our Privacy Policy explains what ad networks may collect and how to opt out.
You keep ownership of what you post: listing text, photos, dealer descriptions and anything else you submit. You give MotoGossip a worldwide, non-exclusive, royalty-free licence, which we may sublicence to the service providers who help us run the site, to host, store, reproduce, adapt (for example format changes and thumbnails), display and distribute it on MotoGossip and in our newsletters and social posts, including on X, for as long as the content is on the site and for a reasonable time after for backups. You confirm you have the right to grant that licence and that the content does not infringe anyone else’s rights or break the law. If you send us feedback about the site, we may use it without owing you anything.
The MotoGossip name, logo, site design, price index, news selection, and every merchandise design belong to MotoGossip or its licensors. You get a limited, revocable, non-transferable licence to use the site for its intended purpose, and nothing more. You may not copy, scrape, resell, print or reproduce our content without written permission. Open-source components we use are covered by their own licences. Motorcycle makes and models named on the site are the trademarks of their manufacturers and are used to describe bikes, not to suggest any affiliation.
MotoGossip is an interactive computer service under 47 U.S.C. 230. We have no general obligation to monitor content, but we may review, remove or restrict any content or account at our discretion, with or without notice. Report a listing, a dealer page or other content to [email protected]. We may preserve and disclose content to comply with the law, enforce these Terms, or protect people, and we cooperate with law enforcement. Accounts that repeatedly infringe copyright are terminated.
Our Designated Agent for copyright notices under the Digital Millennium Copyright Act is: MotoGossip, DMCA Agent, [email protected]. A takedown notice must include the elements listed in 17 U.S.C. 512(c)(3): identification of the copyrighted work, identification of the material and its location, your contact details, a statement of good faith belief that the use is not authorized, a statement made under penalty of perjury that the notice is accurate and that you are authorized to act, and a physical or electronic signature. Someone whose content is removed may send a counter notice under 17 U.S.C. 512(g). We may forward either notice to the other party. Knowingly misrepresenting that content infringes, or that a removal was a mistake, can carry liability under 17 U.S.C. 512(f). Trademark complaints go to the same address.
Listings, news articles, dealer websites, parts sources, Stripe (payments), Printful (shop fulfilment), and other services we rely on are run by other companies with their own terms and privacy policies, including the Stripe Services Agreement for payments. We are not responsible for those sites or services, for what they charge, or for what happens on them.
MotoGossip is provided as is and as available. We work to keep listings fresh, the index honest and the shop shipping, but we do not promise that the site, the price verdict, any listing, or any product description is accurate, complete, uninterrupted or error-free. User content is not endorsed by us. We disclaim every warranty the law allows us to disclaim, including merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent allowed by law, MotoGossip is not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, or a purchase or sale that went wrong, arising out of your use of the site, a listing, or a product. Our total liability to you for anything connected with MotoGossip is limited to the greater of the amount you paid us in the twelve months before the claim and one hundred US dollars ($100). This limit does not apply where the law does not allow it, including for our gross negligence, wilful misconduct, or death or personal injury caused by our negligence. Some states do not allow some of these limits; in those states they apply only as far as the law permits.
You will defend and hold harmless MotoGossip and its owners, staff and contractors from any claim, loss or expense (including reasonable legal fees) arising from your listings, your dealer content, your use of the site, or your breach of these Terms.
Informal resolution first. Before either of us starts a formal claim, write to [email protected] with your name, your account, and what the claim is about. We will try to resolve it within 60 days.
Arbitration. If that does not resolve it, you and MotoGossip agree to resolve any claim through binding individual arbitration under the American Arbitration Association’s Consumer Arbitration Rules, rather than in court, and the arbitrator, not a court, decides what claims can be arbitrated. The arbitration is seated in Victoria County, Texas, but hearings can be held by video or phone. AAA fees follow its rules, and we will pay any filing fee above what it would have cost you to file in court. The Federal Arbitration Act governs this section.
No class actions. Claims must be brought individually, not as a plaintiff or class member in any class, consolidated, or representative action, and not before a jury. If a court decides this class action waiver cannot be enforced for a particular claim, that claim (and only that claim) is decided in court instead of through class arbitration.
Opting out. You can opt out of this arbitration agreement by emailing [email protected] within 30 days of the date you first agreed to these Terms, with your name and account. Opting out does not affect any other part of these Terms.
Carve-outs. Either side can bring an individual claim in small claims court instead of arbitration. Either side can seek an injunction in court to stop infringement of intellectual property rights.
Batching. If 25 or more similar arbitration demands against us are filed by the same or coordinated counsel, they will be administered in batches of 25 claims at a time, and the arbitration provider’s rules for mass filings apply.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. If you live somewhere with consumer protection rights that this section cannot waive, you keep those rights.
You can stop using the site and ask us to delete your account at any time, in-app or by emailing [email protected]. We can suspend or end your access at any time for breaking these Terms, for risk to the site or other users, for legal reasons, or if an account has been inactive for more than 24 months. When an account ends, the licence you gave us to your content ends, and we may delete your data after 30 days, subject to the retention periods described in the Privacy Policy. Sections that by their nature should survive (including sections 10, 11, 14, 17, 18, 19 and 20) do survive.
We update these Terms when the site changes. For a material change, we give notice by email or in the product at least 14 days before the new version takes effect, except for a change required by law or for a new feature, which can take effect when posted. The version and date at the top tell you which one you are reading. Signed-in accounts are asked to agree to a new version before they list, feature, manage a dealer page or check out again. Continuing to use the site after a change takes effect means you accept it; if you do not agree, stop using the site and close your account.
